Nitions & Interpretation

LJC EXPRESS a company incorporated in singapore with its registered office at 21 Moonstone Lane #06-02(D), Singapore 328462.

Terms and Conditions means the Terms and Conditions That apply to the Services as set out on www.LJCEXPRESS.com.sg and may be amended from time to time.

Headings are for convenience only and do not affect interpretation. The singular includes the plural and the masculine shall include the feminine and neuter and vice versa.

A reference to a person, corporation, trust, partnership, unincorporated body or other entity includes any of them.

Customer same as the client is a business entity and offer LJC EXPRESS services, the one who paying LJC EXPRESS for the delivery booking and is inputting the delivery information into our platform.

Delivery Booking means the delivery of items requested by the client to the customers to be collected from one location (pick-up) and delivered to another place (delivery point).

Multiple Booking means the delivery of items requested by the client to the customers to be collected from one location (pick-up) and delivered to multiple delivery point.

Delivery information mean all data required by LJC EXPRESS to accept a delivery booking, which will include some or all of the following:

• Choose of service,Doc,Parcel,Van and Date.
• Customer name,email,contact detail (preferable a contact that can be reached while the delivery is taking place).
• Pick-up address (full address, including street name,building and unit numbers, postal code, and any other relevant instruction). Where different from the customer , the name, email and contact detail of the person who will be handling the items to the drivers at the pick-up address.
• Delivery address (full address, including street name,building and unit numbers, postal code, and any other relevant instruction). Receiver name,email,contact detail (mobile preferable).
• Special instruction to be taken in respect for the delivery service.
• 3 Services Doc less than 500g, above 500g to 2kg Parcel, above 2kg to 20kg Van( Normal Service booking before 10am and send before 6pm).
• Over weight, special timing , urgent service, special delivery write in Email accounts@ljcexpress / call 6396-6691 for booking arrangement. (platform only available for normal service delivery).

Additional Charges

Total charges of equal to Standard Delivery Fee plus additional charges. Standard Delivery Fee include only transportation of item with specified maximum weight,size, and quantity.

Customers shall give LJC EXPRESS sufficient,accurate and executable instructions. Any extra costs arising from the different between the provided information and actual situation shall be borne by the customer.

Driver will wait for maximum of 10mins at both the pick-up and delivery address unless instructed otherwise by LJC EXPRESS as appropriate.

To avoid dispute, our drivers will provide photo-evidence of the address captured within their phones as proof of arrival in the event of unsuccessful pick-up and delivery.

In the event of unsuccessful pick-up / delivery LJC will call customer to request further instructions on how to proceed, however if we are unable to contact either customer or receiver, you authorise LJC EXPRESS to decide on your behalf as we deem appropriate. You acknowledge that additional charges might arise.

Additional charges will be quoted base on the information and requirements that customers provides. Customer shall give Driver sufficient,accurate and executable instructions. Any extra costs arising from the difference between the provided information and actual situation shall be borne by the customer.

You must keep secure and confidential and not disclose to any third party any username / password that we may provide to you in relation to access to LJC EXPRESS and the services. We shall assume that any person using your mobile device, your username and password is you / a person authorised by you.

Obligation

Customer warrants:

That he is either the owner or the authorised agent of the owner of the goods, and that he is authorised to accept and is accepting these conditions not only himself but also as agent for and on behalf of the owner of the goods.

Delivery information is correct.

You have sole and exclusive title to the contents of the items and that you are entitled to have it delivered to the receiver.

Customer shall ensure that every items is adequately packed to protect against damage in the course of transmission.

Customer warrants that he has complied with all laws and regulations relating to the nature, condition, packing, handling, storage and carriage of the goods. Customer shall not despatch and Drivers reserve the right to refuse any articles that are prohibited by law,dangerous or hazardous materials,perishable substances, and radioactive material. Customer is liable for any loss or damage suffered by any third party as a result of any breach of the terms.

Drivers will not open and inspect the delivery items and bear no responsibility in any legal liability resulting from the transportation of the items.

Items that LJC EXPRESS are unable to deliver include, without limitation:

Live animals and insects.

Any restricted / illegal substances, regardless of whether they are prescription quantity or not under the laws of singapore. (Firearms, Ammunition, Human / Animal remains, Noxious substance, Perishable food items, Unsolicited indecent item or representation of any kind, Any item that is capable of causing injury to any person or property regardless of packaging, Valuable items such as bullion, cash, or currency, Original documents which cannot be reproduced e.g share certificate, birth certificate, passport, title deeds, drawing, recording, live plants, items value no more than $1000, items exceeding LJC EXPRESS weight and size specification.

Additional charge for restricted area Casino, Free Trade Zone, Jurong Island, Port, Airport, Cargo Complex, Military and etc.

Services

LJC EXPRESS will be provided with reasonable care and skill and that it will use commercially reasonable effort to meet each delivery. Sometimes deliveries may be delayed due to unforeseen circumstance e.g Festive season, event F1, road closures, bad weather condition. LJC EXPRESS will make reasonable efforts to contact with receiver and reschedule another delivery if needed.

We offer a technology platform to provide information and a means for you to obtain transport and logistics services from Driver through the use of LJC EXPRESS. LJC EXPRESS allow you to send a request for transport and logistics services to driver and each relevant driver has the sole discretion to accept or reject each such request.

All booking must comply with our specification. If a booking does not comply with our specifications then we may decline to deliver your items. We may also terminate / suspend your account with us and charge you for any associated costs. You hereby indemnify us for all costs incurred as a result of non-compliance with our specification.

Your booking is deemed completed upon receipt by LJC EXPRESS of proof of delivery by name in electronic / written form / other evidence such as the driver confirmation of delivery.

The item will be delivered to the specific address in the receiver information but not necessarily to the named recipient personally. Nonetheless, the name of the person will captured together with his/her name upon delivery by the driver.

Tracking will be possible on the service level but not on the items level. you should keep track what items are inside each package.

The full price will be applied to the customer if booking is cancelled when the driver is already on the way to pick-up the item.

Customer Liability

You acknowledge and agree that we only act as an intermediary between you and the driver and we are not your agent / the agent of the driver.

We are not responsible for the behaviour, negligence, conduct, action or inactions on the part of the driver that you may use through LJC EXPRESS.

We shall never be a party to any agreement entered into between you and any driver. If you have any complaint in relation to the transport and logistics service provided then that dispute must be taken up with the driver directly.

Customer to comply with all applicable laws while using LJC EXPRESS:

• You will not use LJC EXPRESS to cause nuisance, annoyance or inconvenience.
• To refrain from doing anything which we reasonably believe to be disreputable or capable of damaging our reputation;
• To provide us with whatever proof of identity we may reasonably request;
• To treat Driver with respect and not to cause damage to their vehicles or engage in any unlawful, threatening, harassing, abusive behaviour or activity whilst using their vehicle.
• To compensate and defend us fully against any claims or legal proceedings brought against us by any other person.

We reserve the right to suspend, restrict or terminate your access to LJC EXPRESS platform at any time without advance notice or liability if we have reasonable grounds to believe you have breached any of these Terms / in our opinion you misuse LJC EXPRESS platform. This shall not limit our right to take any other action against you that we consider appropriate to defend our rights or those of any other person.

Indemnification by accepting these Terms and using LJC EXPRESS platform, you agree that you shall defend, indemnify and hold us, our affiliates and each of our and their respective directors, other user, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) arising out of or in connection with your violation or breach of any term of these Terms or any applicable law or regulation, whether or not referenced herein your violation of any right of any third party, including driver via LJC EXPRESS platform, or your use or misuse of LJC EXPRESS platform.

You agree that LJC EXPRESS has the right to communicate with you through email or whatever other means of updates, changes, etc to the service as well as any special offers or promotions offered by LJC EXPRESS.

You have agree Drivers shall make reasonable effort to deliver the items according to the respective delivery schedules, which are estimates only and not guaranteed. Drivers shall however not be liable (whether in contract, tort or otherwise) for any delays in effecting delivery of the article for whatever reasons.

Customers shall file any dispute by contacting LJC EXPRESS regarding his / her booking within 24hr of booking time. However , LJC EXPRESS reserves the right to without prejudice to the foregoing and insofar as permitted under applicable law, our aggregate liability shall in no event exceed an amount of SGD$100 / no amount decided by LJC EXPRESS. LJC EXPRESS reserves the right not to entertain any disputes after the deadline (after 24hr after booking time) and no claim amount will be paid out.

LJC EXPRESS may assign, transfer or sub-contract its rights and obligations under these Terms and Conditions to any third party sub-contractor without prior notification to you. Any sub-contract or agent of LJC EXPRESS shall entitled to rely on and enforce any of these Terms and Conditions as if it were a party to them in the place of LJC EXPRESS.

The customer may not assign / transfer / sub-contract its rights or obligations under these Terms and Conditions.

The customer agrees that so long as the customer have not terminate these Terms and Conditions, and for a period 200days following termination, customer will not hire, solicit / entice any LJC EXPRESS drivers / sub-contractors introduced to client as a result of customer use of LJC EXPRESS platform, to perform any delivery services whatsoever of customers in replacement any delivery service that could be provided to customer through LJC EXPRESS platform. In the event that customers obtains the delivery services of such driver / sub-contractors customer hereby agrees to pay LJC EXPRESS the fees that customer would have paid to LJC EXPRESShad customer obtained such services through LJC EXPRESS platform.
